The UAE patent system is a statutory framework centered on Federal Law No. 11 of 2021 on the Regulation and Protection of Industrial Property Rights, with implementing regulations and guidelines from the UAE Ministry of Economy governing applications, examination, and disputes. It features a unique structure that integrates three types of intellectual property—patents, utility models, and designs—marking a significant modernization from the previous law of 2002.
Four Key Points to Keep in Mind for UAE Patent Practice
The “primary law” of the UAE patent system is Federal Law No. 11 of 2021 on the Regulation and Protection of Industrial Property Rights (effective November 30, 2021), which fully replaced the previous law of 2002 (Federal Law No. 17 of 2002).It systematically stipulates the definition of an invention, novelty and inventive step, patentable subject matter, application procedures, the scope of patent rights, utility models, industrial designs, compulsory licenses, infringement, and criminal penalties.
The Industrial Property Department of the UAE Ministry of Economy—headquartered in Abu Dhabi—is responsible for patent examination and registration. It has established an e-Filing System and the UAE Patent Database. Procedures can be conducted in Arabic or English.

De facto suspension of the GCC patent system (January 2021)
The GCC Patent System (GCC Patent Office, Riyadh) was a regional system that provided protection across all six member states—the UAE, Saudi Arabia, Qatar, Bahrain, Oman, and Kuwait—with a single application. However, it ceased accepting new applications on January 6, 2021. While existing cases will continue to be processed, separate national applications are now required in each country.
Patent Strategies for Japanese Companies in the Middle East
The UAE joined the PCT in March 1999. National phase entry is possible within 30 months of the priority date (extendable by an additional 3 months, subject to a surcharge). PPH agreements are limited—as of April 2026, no PPH agreement has been concluded between the JPO and the UAE.
Alternative to accelerated examination: Although PPH has not been established, PCT-PPH (accelerated examination based on search results from the PCT international phase) can be utilized. If there are positive search results from the EPO, USPTO, or JPO, examination efficiency can be expected in the UAE as well.
Remedies Available at the UAE Federal Court of Appeal
By registering a patent recordal with the UAE Federal Customs Authority, it is possible to stop the import of counterfeit goods. The Jebel Ali Free Zone (Dubai) and Khalifa Port (Abu Dhabi) are the leading maritime hubs in the Middle East and serve as major distribution centers for counterfeit goods.
Criminal penalties for patent infringement include imprisonment for up to one year and a fine of AED 50,000 to 1,000,000. Penalties are increased for repeat offenses.
