8. Current Status of the GCC Patent System

De facto suspension of the GCC patent system (January 2021)

The GCC Patent System (GCC Patent Office, Riyadh) was a regional system that provided protection across all six member states—the UAE, Saudi Arabia, Qatar, Bahrain, Oman, and Kuwait—with a single application. However, it ceased accepting new applications on January 6, 2021. While existing cases will continue to be processed, separate national applications are now required in each country.

Patent Strategies for Japanese Companies in the Middle East

  • Cover the UAE alone, or file separate applications in Saudi Arabia, Qatar, etc.
  • Market Size Priority: UAE > Saudi Arabia > Qatar > Oman
  • Filing via the PCT is the most efficient approach in practice
  • Be aware of renewal issues for existing GCC registrations starting in 2024

9. PCT and PPH Strategies

The UAE joined the PCT in March 1999. National phase entry is possible within 30 months of the priority date (extendable by an additional 3 months, subject to a surcharge). PPH agreements are limited—as of April 2026, no PPH agreement has been concluded between the JPO and the UAE.

Alternative to accelerated examination: Although PPH has not been established, PCT-PPH (accelerated examination based on search results from the PCT international phase) can be utilized. If there are positive search results from the EPO, USPTO, or JPO, examination efficiency can be expected in the UAE as well.

Criminal Penalties

Criminal penalties for patent infringement include imprisonment for up to one year and a fine of AED 50,000 to 1,000,000. Penalties are increased for repeat offenses.
