Q. Is copyright registration necessary?

Since copyright arises automatically upon creation, registration is not a prerequisite for the existence of rights. However, registering with the Agency for Cultural Affairs (such as registering the date of first publication) makes it easier to assert your rights against third parties. We particularly recommend registering the transfer of rights if you have acquired a copyright assignment.

Q. Does AI-generated content have copyright?

In principle, copyright does not arise for content generated autonomously by AI. However, if a human makes a “creative contribution” through prompt design, selection, or editing, it may be recognized as a copyrighted work. This is an area where debate continues, and each case must be evaluated individually.

Q. Who owns the copyright to a design commissioned from a production company?

As a general rule, copyright belongs to the production company (or designer) that actually created the work. For the client to acquire copyright, the transfer of copyright must be explicitly stated in the contract. Additionally, since moral rights cannot be transferred, a clause stating that "moral rights will not be exercised" is also important.

Q. How can I stop the unauthorized use of images posted on social media?

First, submit a takedown request to the platform based on the DMCA (Digital Millennium Copyright Act). For services based in Japan, you can also request measures to prevent transmission under the Act on Limitation of Liability of Internet Service Providers. In severe cases, consider sending a warning letter or filing a claim for damages.
