Introduction to Our Consulting Service Plans

What Is a Retained Patent Attorney?

A retained patent attorney is a patent attorney who enters into an ongoing retainer agreement with a company or sole proprietor and, for a fixed monthly fee, handles all consultations and filing procedures related to intellectual property (patents, trademarks, designs, copyrights, trade secrets, etc.). We work alongside you to design and execute intellectual property strategies that align with the growth of your business.

📌 Features of the Retained Patent Attorney Service

  • Fixed monthly fee: No per-consultation charges
  • Dedicated Patent Attorney: A patent attorney with a deep understanding of your company’s business and technology will serve as your consistent point of contact
  • Collaborative IP Strategy: We go beyond one-off filing representation to design an IP portfolio tailored to your business growth
  • Emergency Response: Prompt handling of urgent matters such as notices of rejection, infringement warnings, and unauthorized trademark registrations
  • One-Stop Service: Comprehensive coverage ranging from patents, trademarks, and designs to copyrights, contract reviews, and dispute resolution
  • Member Rates: Application and litigation fees for individual cases are kept low through member rates

This service is ideal for companies—from technology-based startups to publicly traded firms—that want to maximize the use of intellectual property as a “business asset.”

5 Benefits of a Retainer Agreement

⚡ 1. Immediate Consultation and Response

Feel free to consult with us anytime via phone, chat, or email. We treat urgent matters (such as infringement warnings or notices of rejection) as top priority.

💡 2. Support for Your IP Strategy

Long-term IP portfolio design aligned with your business plan. A strategic perspective that cannot be achieved through one-off application services.

📚 3. In-House IP Training

We continuously conduct invention brainstorming sessions, training programs, and seminars to enhance IP literacy among engineers.

💰 4. Member Rates & Priority Service

Individual cases—such as applications, litigation, and investigations—are handled at member rates. This results in total cost savings of 10–30% compared to one-off requests.

🔒 5. Proactive Risk Mitigation

We minimize litigation risks through freedom-to-operate (FTO) searches prior to new product releases, contract reviews, and early detection of trademark infringement.

"Frequently Asked Questions" About Patent Attorney Advisory Services

Q : Is there a minimum contract term for advisory services?
We recommend a minimum contract term of 6 months. Since the effects of an IP strategy become apparent over the medium to long term, working with us for about half a year will help maximize those effects. We can also flexibly accommodate contract cancellations or plan changes during the term.
Q : Are application filing fees included in the retainer fee?
The retainer fee covers consultations, research, strategy development, in-house training, and similar services. Application filing fees (such as drafting the specification and Japan Patent Office fees) are billed separately at member rates, but a 10–30% discount compared to one-time service rates applies. The scope of services included varies by plan, so please refer to the fee schedule for details.
Q Is there a limit to the number of consultations per month?
There is no limit on routine consultations via phone, chat, or email. For in-person and online meetings, there are recommended frequencies based on each plan (Small: once a month; Medium: twice a month; Large: four times a month; Premium: once a week).
Q Is there a dedicated patent attorney assigned to me?
Yes, you will be assigned a dedicated patent attorney. We assign the most suitable attorney based on your technical field (IT, mechanical engineering, chemistry, biotechnology, etc.). This allows us to provide ongoing support based on a deep understanding of your business and technical background.
Q : Can I change my plan?
Yes, you can change your plan (upgrade or downgrade) at any time during the contract period. We offer flexible support to accommodate your business growth and peak periods. Many clients start with the Small plan and expand as their business grows.
Q : Do you provide support for international applications?
Yes. We provide one-stop service for international applications, including PCT international patent applications, Madrid Protocol international trademark applications, and Hague International Design applications. We can also assist with applications for the INPIT Foreign Application Subsidy (100% approval rate).
Q : Does this include handling infringement warning letters and litigation?
Handling of infringement letters and litigation varies depending on the plan. The Small through Large plans include initial response and strategy development; full-scale litigation support is quoted separately at member rates. The Premium Plan includes litigation support.
Q : Can you assist companies located in regional areas?
Yes, we serve clients nationwide. In addition to online tools such as phone, LINE, Slack, Zoom, and Teams, our patent attorneys will visit your location (factory or office) as needed. We have extensive experience supporting companies in regional areas.
Q : Can we sign a Non-Disclosure Agreement (NDA)?
Yes, we will sign an NDA (Non-Disclosure Agreement) before your initial consultation. Patent attorneys are also legally bound by a duty of confidentiality (Article 29 of the Patent Attorney Act), so you can feel secure sharing your technical information with us. We can also accommodate your company’s standard NDA form.
Q : Is a free consultation available?
Yes, the initial consultation is free of charge. Please feel free to contact us by phone (+81-6-7777-1884), email, or through our contact form. After learning about your business, we will propose the optimal plan and provide a free estimate.
